These Terms & Conditions (“Terms”) govern your access to and use of the website operated by Toffee Design Studio at toffeesdesignstudio.com (the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to your use of the Site only. Any design, development, branding, or consulting work we perform for you will be governed by a separate proposal, statement of work, or client agreement (“Project Agreement”). If there is a conflict between these Terms and a signed Project Agreement, the Project Agreement controls for that project.

Toffee Design Studio is a design studio offering AI automation, UI/UX design and development, branding, and design partnership services for startups and growing brands. Information on the Site is provided for general informational purposes and does not constitute a binding offer unless confirmed in writing through a Project Agreement.

You may use the Site for lawful purposes and in accordance with these Terms.

You agree not to misuse the Site, attempt to gain unauthorized access to our systems, interfere with Site operation, scrape content in a way that harms our services, or use the Site in any manner that violates applicable law.

You may not use the Site to transmit spam, malware, or harmful code.

Unless otherwise stated, the Site and its contents — including text, visuals, layouts, logos, graphics, animations, code, and portfolio presentations — are owned by Toffee Design Studio or our licensors and are protected by intellectual property laws.

You may view and share links to the Site for personal or business reference. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from Site content without our prior written permission, except as allowed by law.

Portfolio work displayed on our Work pages remains the property of its respective owners. It is shown with permission for demonstration purposes only.

Scheduling a call through our Book a call page or contacting us by email does not create a client relationship or obligate either party to begin a project. Project scope, fees, timelines, and deliverables are confirmed only in a separate written agreement.

Third-party scheduling tools, including Cal.com, are subject to their own terms and privacy policies.

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components, or that information on the Site is complete, current, or accurate.

To the fullest extent permitted by law, Toffee Design Studio and its owners, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site will not exceed one hundred U.S. dollars (USD $100) or the amount you paid us directly for use of the Site in the twelve months before the claim, whichever is greater.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Toffee Design Studio from and against claims, damages, losses, and expenses arising out of your misuse of the Site or violation of these Terms.

The Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk.

We may update the Site or these Terms at any time. Updated Terms will be posted on this page with a revised last updated date. Continued use of the Site after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles, except where mandatory local law requires otherwise.
